These terms govern the placement, acceptance, and fulfillment of any order submitted through the Nacon Gaming Shop and General Electronic for gamers website.
1. Order Placement and Acceptance
Offer to Purchase: Placing an order on our website constitutes an offer to purchase the selected products subject to these Terms and Conditions.
Order Acceptance: An order is deemed accepted only when Nacon Gaming Shop sends a formal Shipping Confirmation Email to the customer, confirming that the product has been dispatched. Our initial Order Confirmation Email only acknowledges receipt of your offer and does not constitute acceptance.
Refusal Rights: We reserve the right to refuse or cancel any order at our sole discretion for reasons including, but not limited to:
Product unavailability or discontinuation.
Errors in pricing or product description.
Suspicion of fraudulent activity or unauthorized resale.
Inability to confirm payment or shipping details.
2. Pricing and Availability
Pricing Finality: Product prices are fixed at the time the order is placed. However, we reserve the right to correct pricing errors found after order submission. In such cases, we will notify the customer and provide the option to proceed at the correct price or cancel the order.
Cryptominer Pricing: Due to extreme market volatility, the pricing for all Cryptocurrency Miners (ASIC/GPU) may be subject to immediate change without prior notice until the order is formally accepted and payment is confirmed.
Pre-Orders and Backorders: Orders for products listed as “Pre-Order” or “Backorder” will be fulfilled on a first-paid, first-served basis according to the manufacturer’s expected delivery schedule. Estimated shipping dates are subject to change and are not guaranteed.
3. Payment Conditions
Full Payment Required: Full payment is required upon placing the order, including the cost of the product(s), shipping fees, and any applicable taxes or duties.
Payment Verification: All payments are subject to verification and authorization by the payment provider. We will not be liable for any delivery delay or non-delivery resulting from a failure or refusal of the payment authorization.
Cryptocurrency Payments: Payments made using cryptocurrency are final and calculated based on the exchange rate effective at the time of payment confirmation. Any fluctuations in the crypto market after payment confirmation will not affect the final order price.
4. Shipping and Risk of Loss
Shipping Arrangement: The cost and method of shipping will be specified at checkout. Nacon Gaming Shop is not responsible for delays caused by the carrier.
Title and Risk Transfer:Title to the goods and the risk of loss transfers from Nacon Gaming Shop to the customer upon our delivery of the item(s) to the designated carrier.
Customs and Import: For international orders, the customer is the importer of record and is solely responsible for all customs duties, import taxes, brokerage fees, and any governmental regulatory charges associated with the shipment. Failure to pay these charges and subsequent refusal or abandonment of the package will result in the loss of the purchase price and no refund will be issued.
5. Order Changes and Cancellations
Cancellation Policy: A customer may request to cancel an order only before the order has entered the “Shipping Processing” stage. Once an item is allocated, packaged, or in the possession of the carrier, the order cannot be canceled.
Cryptominer Exception: Orders for Cryptocurrency Miners are generally non-cancellable after payment has been confirmed due to the specialized logistics and commitment required for these items. Any exceptions will be at our sole discretion and may be subject to a restocking or cancellation fee of up to 20% of the total purchase price.
Changes: We cannot guarantee the ability to modify an order (e.g., changing models or shipping address) once placed. Any requested changes may cause delays.
